These Terms & Conditions govern your use of membership services provided by Aquila Gym & Fitness, operated by Kevin Murthy, located at No. 34-02, Jalan Kolam Air 2, Taman Nong Chik, 80100 Johor Bahru, Johor, Malaysia. By submitting the membership form and completing payment, you agree to these terms.

By subscribing, you authorise Aquila Gym & Fitness to charge your registered payment card on a recurring basis according to your selected plan: RM 99 per month (Monthly) or RM 269 per 3 months (Quarterly). Your first charge occurs on the date of registration. Subsequent charges occur automatically on the same date each billing cycle.

All payments are processed securely through Stripe, a PCI DSS Level 1 certified payment processor. Aquila Gym & Fitness does not store, access, or handle your card details directly.

You may cancel your membership at any time by notifying us via WhatsApp or in person. Upon cancellation, your membership remains active until the end of your current paid billing period. No partial refunds are issued for unused days within a billing cycle. There are no cancellation fees or penalties.

If a recurring payment fails due to insufficient funds, expired card, or any other reason, we will notify you via WhatsApp and provide a link to update your payment details. If payment is not resolved within 7 days, your membership access may be temporarily suspended until payment is completed.

The initial setup payment and all recurring charges are non-refundable for the current billing period once processed. If you believe a charge was made in error, contact us within 7 days and we will investigate and resolve it promptly.

By submitting the membership form, you consent to receive communications from Aquila Gym & Fitness via WhatsApp, phone call, SMS, and email. These communications include payment confirmations, billing reminders, membership updates, training tips, promotions, and gym announcements.

You may opt out of promotional messages at any time by replying "STOP" or notifying us directly. Transactional messages related to your billing and membership status will continue as long as your subscription is active.

In compliance with the Personal Data Protection Act 2010 (PDPA) of Malaysia, we are committed to protecting your personal information. The data we collect (name, phone number, email, payment information, and fitness goals) is used solely for the purpose of managing your gym membership, processing payments, and communicating with you about your account.

Your personal data will not be sold, rented, or shared with any third party for marketing purposes. Data is only shared with our payment processor (Stripe) for the purpose of processing your subscription payments. You have the right to request access to, correction of, or deletion of your personal data at any time by contacting us.

Members use the gym facilities at their own risk. Aquila Gym & Fitness is not liable for any injury, loss, or damage to personal property that occurs on the premises. Members are responsible for using equipment safely and seeking guidance from staff when unsure. Members with pre-existing medical conditions are advised to consult a doctor before commencing any exercise programme.

Aquila Gym & Fitness reserves the right to update these Terms & Conditions at any time. Members will be notified of any material changes via WhatsApp or email at least 14 days before they take effect. Continued use of the membership after changes take effect constitutes acceptance of the updated terms.

These Terms & Conditions are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Johor Bahru, Johor.
